This book is unique in presenting an interdisciplinary conversation between jurists and logicians. It brings together scholars from both law and philosophy and looks at the application of 'the new logics' to law and legal ordering, in a number of legal systems. The first Part explores the ways in which the new logics shed light on the functioning of legal orders, including the structure of legal argumentation and the rules of evidence. The second addresses how non-classical logics can help us (...) to understand the interactions between multiple legal orders, in a range of contexts including domestic and international law. Drawing on original ethnobotanical and anthropological research among Indigenous peoples across the Amazon, we examine synergies and dissonances between Indigenous and Western scientific knowledge about the environment, resource use, and sustainability. By focusing on the sensory dimension of Indigenous engagements with the environment—an approach we have described as “sensory ecology” and explored through the method of “phytoethnography”—we promote a symmetrical dialogue between Indigenous and scientific understandings around such phenomena as animal–plant mutualisms, phytochemical toxicity, sustainable forest management in “multinatural” landscapes, and (...) the emergence of new diseases like the novel coronavirus SARS-CoV-2 (COVID-19). Drawing examples from our own and other published works, we explore the possibilities and limitations of a “parallax view” attempting to hold Indigenous and scientific knowledge in focus simultaneously. As the concept of “bioeconomy” emerges as a key alternative for sustainable development of the Amazon, we encourage a critical and urgent engagement between dominant Western conceptions and Indigenous Amazonian knowledge, practices, and cultural values. Cognitive science, which has long contributed to studies of Indigenous categorization and conceptualization of the natural world, continues to play an important role in building bridges of mutual communication and respect between Indigenous and scientific approaches to sustainability and biodiversity conservation. The COVID-19 pandemic has inspired numerous opportunities for telehealth implementation to meet diverse healthcare needs, including the use of virtual communication platforms to facilitate the growth of and access to clinical ethics consultation (CEC) services across the globe. Here we discuss the conceptualization and implementation of two different virtual CEC services that arose during the COVID-19 pandemic: the Clinical Ethics Malaysia COVID-19 Consultation Service and the Johns Hopkins Hospital Ethics Committee and Consultation Service. A common strength experienced by both platforms (...) during virtual delivery included improved ability for local practitioners to address consultation needs for patient populations otherwise unable to access CEC services in their respective locations. Additionally, virtual platforms allowed for enhanced collaboration and sharing of expertise among ethics consultants. Both contexts encountered numerous challenges related to patient care delivery during the pandemic. The use of virtual technologies resulted in decreased personalization of patient-provider communication. We discuss these challenges with respect to contextual differences specific to each service and setting, including differences in CEC needs, sociocultural norms, resource availability, populations served, consultation service visibility, healthcare infrastructure, and funding disparities. Through lessons learned from a health system in the United States and a national service in Malaysia, we provide key recommendations for health practitioners and clinical ethics consultants to leverage virtual communication platforms to mitigate existing inequities in patient care delivery and increase capacity for CEC globally. This essay examines the songwriting art of Bob Dylan as a vehicle for exploring and clarifying elements in Bernard Lonergan’s analysis of art. The elements focused upon include Lonergan’s treatment of symbols and symbolic meaning as the communicative medium of art, and, at greater length, Lonergan’s account of art’s capacity for what he calls “ulterior significance,” its ability to suggest depths of meaning—including divine or ultimate meaning—that we surmise to lie beyond our comprehension. Examining songs from the full range of (...) Dylan’s fifty-year career, the essay shows that from his early songwriting in the “folk” tradition and his breakthrough achievements of the mid-1960s, Dylan’s best art has been characterized by an unusual concision and power in its use of symbolic imagery, as well as by a recurrent ability to evoke, with artistic originality and effectiveness, mysteries of “ulterior significance.” These analyses are then brought together in a discussion of the religious, often eschatological, character of some of Dylan’s most significant work. This essay examines the function of the concept of human dignity (both as an inherent feature of human existence and as an ideal achievement) in the United Nations's 1948 Universal Declaration of Human Rights. It explains why the key framers of the document affirmed an inherent human dignity in order to provide an explanatory basis for the validity of universal human rights while eschewing any religious or metaphysical justification for this affirmation. It argues that the key framers, while aware of (...) the Christian anthropology informing the modern Western concept of the dignity of the person, grasped (1) that the Declaration, to be ratifiable, would need to be free of religious reference, and also (2) that the notion of inherency suffices to suggest heuristically not only a universal human nature but also, crucially, a transcendent reality in which all persons participate. _Transcendence and History_ is an analysis of what philosopher Eric Voegelin described as “the decisive problem of philosophy”: the dilemma of the discovery of transcendent meaning and the impact of this discovery on human self-understanding. The explicit recognition and symbolization of transcendent meaning originally occurred in a few advanced civilizations worldwide during the first millennium?.?.e. The world’s major religious and wisdom traditions are built upon the recognition of transcendent meaning, and our own cultural and linguistic heritage has long since absorbed (...) the postcosmological division of reality into the two dimensions of “transcendence” and “immanence.” But the last three centuries in the West have seen a growing resistance to the idea of transcendent meaning; contemporary and “postmodern” interpretations of the human situation—both popular and intellectual—indicate a widespread eclipse of confidence in the truth of transcendence. In _Transcendence and History_, Glenn Hughes contributes to the understanding of transcendent meaning and the problems associated with it and assists in the philosophical recovery of the legitimacy of the notion of transcendence. Depending primarily on the treatments of transcendence found in the writings of twentieth-century philosophers Eric Voegelin and Bernard Lonergan, Hughes explores the historical discovery of transcendent meaning and then examines what it indicates about the structure of history. Hughes’s main focus, however, is on clarifying the problem of transcendence in relation to historical _existence_. Several scholars have recognized the limitations of theories of moral reasoning in explaining moral behavior. They have argued that moral behavior may also be influenced by moral identity, or how central morality is to one’s sense of self. This idea has been supported by findings that people who exemplify moral behavior tend to place more importance on moral traits when defining their self-concepts (Colby & Damon, 1995). This paper takes the next step of examining individual variation in a construct highly (...) associated with immoral behavior — psychopathy. In Study 1, we test the hypothesis that individuals with a greater degree of psychopathic traits have a weaker moral identity. Within a large online sample, we found that individuals who scored higher on a measure of psychopathic traits were less likely to base their self-concepts on moral traits. In Study 2, we test whether this reduced sense of moral identity can be attributed to differences in moral judgment, which is another factor that could influence immoral behavior. Our results indicated that the reduced sense of moral identity among more psychopathic individuals was independent of variation in moral judgment. These results suggest that individuals with psychopathic traits may display immoral behavior partially because they do not construe their personal identities in moral terms. (shrink)

This article examines Bernard Lonergan's account of the meaning, functions, and importance of art, focusing on the chapter on art in his Topics in Education (volume 10 of The Collected Works of Bernard Lonergan), the text derived from his 1959 Cincinnati lectures on philosophy of education. The essay begins by identifying important parallels between Lonergan s analysis of art and selected elements in the philosophies of Aristotle, Saint Augustine, Kant, Hegel, Tolstoy, Collingwood, and Heidegger. It then focuses upon Lonergan's particular (...) emphasis on artistic creation and appreciation as an exercise of human liberty, and as a testimony to the freedom of human consciousness. Voegelin's analysis of mystery is central to his philosophies of conscience existence and history, and plays a crucial role in his critique of modernity. In his view, because human consciousness is a "knowing questioning" that can inquire about what lies beyond the scope of finite intelligence and imagination--that can affirm, for example, a "ground" of being, the ultimate meaning or nature of which transcends all possible knowing from the perspective of finite participation in the process of reality--we can explicitly understand (...) that our existences are embraced by a mystery of transcendent meaning. When such explicit recognition takes place--when consciousness differentiates dimensions of "immanent" and "transcendent" meaning-- everything that pertains to the decisive core of existence becomes haunted by the same dead center of ignorance. The objects of our deepest concerns, such as the ultimate purpose of moral striving, or the meaning of history, are revealed as humanly unknowable in any definitive sense. Such insight into the fact of transcendent meaning has, in Western culture, introduced serious problems into personal and political life. One set of problems concerns the difficulties entailed in explicitly accepting mysteries and in orienting oneself by their truths. A second concerns the temptations of ignoring or denying them. Western modernity has notoriously rejected transcendent meaning and mystery, and in so doing has established cultural conditions tending to promote skewed moral, educational and political ideals. Voegelin's analysis of mystery is part of a therapeutic critique of those conditions, as is his philosophy of myth. Myth, Voegelin argues, is the precise symbolic instrument for the articulation of transcendent meaning, since the myth does not claim to be definitive--it is a likely story that accords with accurate knowledge about reality--and so doesn't violate our awareness of the limitations of human perspective, and the myth tells a story that makes sense, in a context of ultimate meaning, of our experiences of purpose and struggle, risk and failure, desire and achievement. Many of the contributors have been inspired by the philosophical approaches of Eric Voegelin or Eugen Rosenstock-Huessy, and the tension between these two social philosophies adds to the philosophical uniqueness and richness of the work.

Hugh H. Benson explores Plato's answer to Clitophon's challenge, the question of how one can acquire the knowledge Socrates argues is essential to human flourishing-knowledge we all seem to lack. Plato suggests two methods by which this knowledge may be gained: the first is learning from those who already have the knowledge one seeks, and the second is discovering the knowledge one seeks on one's own. The book begins with a brief look at some of the Socratic dialogues where Plato (...) appears to recommend the former approach while simultaneously indicating various difficulties in pursuing it. The remainder of the book focuses on Plato's recommendation in some of his most important and central dialogues-the Meno, Phaedo, and Republic-for carrying out the second approach: de novo inquiry. The book turns first to the famous paradox concerning the possibility of such an inquiry and explores Plato's apparent solution. Having defended the possibility of de novo inquiry as a response to Clitophon's challenge, Plato explains the method or procedure by which such inquiry is to be carried out. The book defends the controversial thesis that the method of hypothesis, as described and practiced in the Meno, Phaedo, and Republic, is, when practiced correctly, Plato's recommended method of acquiring on one's own the essential knowledge we lack.
